Belgian court rejects Kadhafi daughter's NATO complaint

A Belgian court has thrown out a war crimes complaint against NATO filed by Moamer Kadhafi's daughter over charges that a bombing in Tripoli killed her daughter, her brother and other family members.

Aisha Kadhafi sought to seize on laws that give the kingdom's courts universal jurisdiction in war crime and genocide cases whenever the accused or victim are located in Belgium.

NATO is based in Brussels, but the Belgian federal prosecutor's office said Wednesday the court had no jurisdiction because neither the victims nor accused were Belgian, and the alliance officials have diplomatic immunity.

The Libyan regime says one of Aisha's brothers, Seif al-Arab Kadhafi, 29, her four-month-old daughter Mastoura, and nephews Seif and Carthage, both two years old, died in an April 30 NATO raid.

A French court rejected a similar complaint against French President Nicolas Sarkozy, Defence Minister Gerard Longuet and French military officers on June 30.

NATO faced a new court challenge, however, after a Libyan filed a civil lawsuit on Wednesday seeking damages against the alliance over a June 20 bombing, which he says killed his wife and three small children.
